Will Bitfinex get 3.6B $ worth of Bitcoin from the government?

I am of the opinion government should give Bitfinex only 71 million, the value of the bitcoin when it was stolen. Government should keep the rest. Opinions.

The theft wasn't for dollars it was for Bitcoin.

If that were done the flip case would need to be done. Say property was stolen, but then it was found out the property was physically sinking because of bad bedrock and is worthless. The government should then pay full value at the time it was stolen, and take the loss on its diminished value. So the people who had the property then don't lose anything and actually benefit from it being stolen.

Would like such an idea with the 71 million, if also it also happened with the flip side. The government would lose money in this case.

My only issue with that is Bitfinex, a company with lousy security(they lost the coin) now gets a windfall. Is that morally right?

Theft is theft. You don't get only part of your stuff back when the police recover it and find out you did not lock your door. Your insurance might take exception to it but not the law. It if morally and legally right to return all recovered property.

If the government recovers your stolen property they must return it, not appraise it and give you the cash equivalent.

that's theft lol.
